PLAN MODIFICATION

The Department of Environmental Protection (Department) gives notice of its approval of a modification to the North Maxville Mine Conceptual Reclamation Plan submitted by E.I. DuPont de Nemours and Company, Inc, PO Box 753, Starke, FL 32091. This conceptual plan (DU-NM-CPB) modification is to update the existing conceptual reclamation plan to reflect changes approved under Environmental Resource Permit (ERP) modifications # 0169603-019 and 0169603-022. The revisions include changes to pre-mining land uses due to more detailed mapping and field delineation of wetlands associated with the ERP modifications, changes in post-mining land uses, and reconfiguration of wetland reclamation areas. North Maxville Mine is located in Baker County, in portions of Sections 35, and 36, Township 2 South, Range 22 East; and Sections 1, 2, 11, 12, 13, 14, 23, 24, 25, and 26, Township 3 South, Range 22 East. The mine includes land located in the St. Marys River and the St. Johns River watersheds, Class III waters. This application was reviewed pursuant to Chapter 378, Florida Statutes.
This action is final and effective on the date filed with the Clerk of the Department unless a petition for an administrative hearing is timely filed under Sections 120.569 and 120.57, F.S., before the deadline for filing a petition. On the filing of a timely and sufficient petition, this action will not be final and effective until further order of the Department. Because the administrative hearing process is designed to formulate final agency action, the hearing process may result in a modification of the agency action or even denial of the application.
